1 INFORMATION ON THE PROCESSING OF PERSONAL DATA

pursuant to art. 13 and 14 of EU Regulation 2016/679 (hereinafter, only the “Regulation”)

This document (“Policy“) has been prepared pursuant to art. 13 and 14 of EU Regulation 2016/679 (“Regulation“) in order to allow you to understand how your personal data (“Personal Data“) are collected and processed when you browse and use the features of the www.powersoft.com site  (“Site“), and to know our policy on the processing of your Personal Data. In general, the Personal Data that you provide through the Site, or otherwise collected and processed as part of the use of the Site’s features, such as registering and using the MyPowersoft platform, participating in training courses and webinars, sending communications about our products and services, sending an application using the “Work with us” section”, will be processed according to the internationally recognized principles of lawfulness, fairness, transparency, purpose and storage limitation, data minimization, accuracy, integrity and confidentiality.

From the Site it is possible to connect through specific links to other third-party websites. Powersoft S.p.A. informs you that the processing of Personal Data on these sites is carried out by third parties and declines any responsibility for any management of Personal Data by said third party sites and for the management of the authentication credentials provided for registration to them. For processing activities carried out by these third-party sites, we invite you to consult their respective privacy policies.

2 DATA CONTROLLER – WHO WE ARE AND HOW YOU CAN CONTACT US

The Data Controller is Powersoft S.p.A. with registered office in Via Enrico Conti n. 5 – 50188 Scandicci (FI), Italy, VAT number 04644200489 (“Powersoft“, the “Company“, the “Data Controller“). 3 WHAT PERSONAL DATA WE PROCESS

The following are the categories of Personal Data that may be processed when you browse, interact with, and use the features made available on the Site.

a. Browsing data

The Website’s computer systems collect some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with you, but by its very nature could, through processing and association with data held by third parties, allow you to be identified. These include the IP addresses or domain names of the devices used to connect to the Site, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, successful,  error, etc.) and other parameters related to your operating system and computer environment.

These data are used in order to obtain anonymous statistical information on the use of the Site to check its correct functioning, to allow the correct provision of the various functions, for security reasons and to ascertain responsibility in the event of any computer crimes against the Site or third parties.

b. Master Data, Contact Details and Other Personal Data

In some sections of the Site (for example, to register and participate in training courses, webinars organized by Powersoft, or to register, access and use the functions made available on the MyPowersoft platform) we may ask you to provide us with information such as, for example, name, surname, e-mail address, telephone number, country of origin, job title, company for which you work,  information about the Powersoft products you use, etc.

c. Applications and any special categories of Personal Data

If you submit your application using the “Work with us” section of the Site, you authorize Powersoft to process the Personal Data you provide. We invite you not to provide Personal Data falling within the category of special categories of Personal Data referred to in art. 9 of the Regulation (i.e. “[…] data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as […] genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning the person’s sex life or sexual orientation“) unless strictly necessary. Any processing of such Personal Data takes place on the legal basis indicated in section 4.2. In this regard, unless strictly necessary, we ask you not to provide this type of information. Otherwise, if you decide to provide them, you must express your explicit and specific consent to the processing of the special categories of Personal Data.

d. Personal Data collected to provide you with our services and respond to your requests

When you use the features made available on the Site, we may collect certain information, even if you do not provide it directly. This includes, by way of example, information collected when you carry out training courses, webinars, tutorials accessible from the “Training” section of the Site, such as your presence at training courses and viewing available video recordings, or diagnostic or usage information collected through our Powersoft products that you record on the MyPowersoft platform.

e. Personal Data of third parties that you provide through the Site

In some sections of the Site, you may enter text messages or information that may contain Personal Data of other people. In such cases, you act as an independent data controller, assuming all legal obligations and responsibilities. In this sense, you grant the widest indemnity on this point with respect to any dispute, claim, request for compensation for damage from processing, etc., that may be received by Powersoft from third parties whose Personal Data have been processed through your use of the functions of the Site in violation of the applicable regulations on the protection of Personal Data. In any case, if you provide or otherwise process Personal Data of third parties in the use of the Site, you hereby guarantee – assuming all related responsibility – that this particular hypothesis of processing is based on the consent of such third party or on another suitable legal basis that legitimizes the processing of the information in question.

f. Cookie

We may collect Personal Data through cookies and other tracking tools. More information on the use of cookies and similar technologies is available by consulting the cookie policy on the Site.

4 WHY, HOW AND FOR HOW LONG WE PROCESS YOUR PERSONAL DATA

The following section details the purposes for which we may process your Personal Data. For each purpose of the processing, the relevant legal basis, the nature of the provision of Personal Data and the retention period are indicated.

For the pursuit of the purposes set out below, your Personal Data are processed both on paper and with computer and telematic procedures.

4.1.  Services and other features of the Site

Purpose: we process your Personal Data in order to be able to provide you with the services you request through the Site, the use of other features of the Site and to respond to your requests. This is, for example, the processing of Personal Data carried out to allow you to register, participate in our training courses, webinars and tutorials and send you communications with the relevant information, or to register, access and use the services and features available on the MyPowersoft platform, such as managing your repair requests for Powersoft products,  technical support, receive information and quotations on our products and services, manage any complaints. We specify that if you request activities that Powersoft provides with the support, collaboration, or use of the provision of services of its business partners or other third parties acting as independent data controllers (such as, for example, in the case of training courses or webinars hosted on third-party platforms, or in the event that the fulfillment of your requests involves activities of both Powersoft and other subjects),  we may communicate your Personal Data to such third parties if this is necessary for the proper performance of the activity you have requested. As these third parties act as independent data controllers, for more information on the processing of your Personal Data by them, we suggest that you consult their policies on the processing of Personal Data.

Legal basis: the processing for this purpose is carried out by Powersoft in order to be able to provide you with services, use the functionality of the Site and respond to your requests and, therefore, is necessary for the performance of a contract with you and/or for the performance of pre-contractual activities. It is not mandatory to provide your Personal Data for this purpose, but otherwise it will not be possible to provide you with the services, use the features of the Site or respond to your requests correctly.

Retention time: your Personal Data processed for this purpose will be stored for the time strictly necessary to execute the contractual relationship and the activities related to it. In any case, since the processing is carried out within the framework of a contractual relationship, Powersoft will make use of the right, permitted by applicable legislation (art. 2946 of the Civil Code), to retain the Personal Data necessary to protect its interests, for the time provided for by law.

4.2. Recruitment

Purpose: we process your Personal Data in order to be able to examine the applications submitted and to contact the candidates who have sent their application to the contact details in the “Work with us” section of the Site.

Legal basis: We process your Personal Data in order to be able to consider your application and, therefore, it is necessary to be able to start the selection process.

Should you provide special categories of Personal Data necessary for the selection process (e.g. data relating to health, religious orientation, etc.), Powersoft processes these special categories of Personal Data pursuant to Article 9(2)(b) of the Regulation (“[…] the processing is necessary for the performance of the obligations and exercise the specific rights of the controller or the data subject in the field of labour and social security and social protection law, to the extent that it is authorised by Union or Member State law or by a collective agreement under the law of the Member States,  in the presence of appropriate safeguards for the fundamental rights and interests of the data subject“), in accordance with the provisions of the Guarantor for the Protection of Personal Data in force at the time.

In accordance with the pro tempore provision in  force, we invite you in any case not to provide Powersoft data falling within the category of special categories of personal data pursuant to Article 9 of the Regulation (such as Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data,  biometric data intended to uniquely identify a natural person, data relating to health or data relating to the sex life or sexual orientation of the person) that are not strictly necessary in view of the particular tasks and/or the specificities of the professional profiles requested, and we inform you that, if you nevertheless provide such special categories of Personal Data,  these will not be taken into consideration by Powersoft, which will delete them.

It is not mandatory to provide your Personal Data for this purpose, but if you do not, your application will not be considered.

Retention period: Personal Data processed for this purpose are kept for the time necessary to complete the selection process and for a further 6 months.

4.3. Marketing

Purpose: We may process your Personal Data to carry out marketing activities, such as conducting surveys and market research, sending you newsletters, marketing communications, promotions and advertising by email, telephone, through Powersoft’s social media pages, relating to Powersoft’s activities, products and/or services.

Legal basis: The processing for this purpose is carried out by Powersoft with your consent. It is not mandatory to give your consent for this purpose and we remind you that you are free to revoke any consent provided at any time and without any consequence (except for the fact that you will no longer receive marketing communications). To request the withdrawal of the consent previously given, you can write to privacy@powersoft.com at any time.

Retention time: your Personal Data may be processed by Powersoft for this purpose until you withdraw your consent and in any case up to a maximum of 24 months from the last consent given.

4.4. Personalization

Purpose: We may process your Personal Data to analyze your interests, for example based on the training courses and webinars you attend, your purchasing choices, the interactions you have with the contents of the newsletter, so that we can send you personalized information and promotional material on the services and products offered by Powersoft that we believe may be of interest to you,  create a profile through the use of marketing/profiling cookies, where accepted, by collecting and analyzing information about your preferences and choices expressed on the Site.

Legal basis: Processing for this purpose is based on your consent. It is not mandatory to give your consent for this purpose and you are free to withdraw it at any time without any consequences (except for the impossibility of benefiting from the personalization of Powersoft’s communications and offers). We inform you that you can revoke the consent previously given at any time by writing to privacy@powersoft.com.

Retention time: your Personal Data may be processed by Powersoft for this purpose until you withdraw your consent and in any case up to a maximum of 12 months from the last consent given.

4.5. Compliance

Purpose: We may process your Personal Data to comply with legal obligations that require Powersoft to collect and/or further process certain types of Personal Data.

Legal basis: the processing for this purpose is necessary in order to comply with any legal obligations. When you provide Personal Data, it must in fact be processed according to the applicable legislation, which may also involve its storage and communication to the competent authorities for accounting, tax or other obligations.

Retention time: Personal Data processed for this purpose will be kept for the period provided for by the specific legal obligations or applicable legislation to which Powersoft is subject.

4.6. Abuse, fraud and legal protection

Purpose: We may process your Personal Data to prevent or detect any abuse in the use of the Site, or any fraudulent activity or in any case in violation of Powersoft’s rights and interests and therefore allow Powersoft to protect itself in and out of court.

Legal basis: the Personal Data used to prevent and/or detect any fraudulent activities or abuses in the use of the Site or other violations of Powersoft’s rights and interests, are processed on the basis of Powersoft’s legitimate interest in order to allow the most appropriate protection in and out of court.

Retention time: the Personal Data processed for these purposes are stored for the time strictly necessary for the aforementioned purpose and therefore until the moment in which Powersoft will be required to retain them to protect itself in court and out of court and for any communication of the data to the competent authorities.

4.7. Research and development

Purpose: We may process Personal Data, including those relating to the Powersoft products that you register through MyPowersoft and information about their use and operation, to carry out product research activities, with a view to developing new solutions aimed at the continuous improvement of our products and services.

Legal basis: Processing for this purpose is based on our legitimate interest.

Retention time: Personal Data processed for these purposes are stored for the time strictly necessary and in any case until the MyPowersoft account is active.

4.8. Recipients

Your Personal Data may be shared with the following entities (the “Recipients“):

  • subjects who typically act as data processors, namely: persons, companies or professional firms that provide services, assistance and consultancy activities in accounting, administrative, legal, tax, financial and debt collection matters relating to the provision of the Services;
  • subjects with whom it is necessary to interact for the purposes indicated in section 3, for example to provide you with the services of the Site, use the features of the Site, send you communications, etc. (for example, hosting providers or providers of platforms for sending emails);
  • external parties delegated to carry out repair, maintenance, technical assistance, etc., activities that need access to them;
  • persons authorized by Powersoft to process Personal Data necessary to carry out the activities described in this Policy, who have committed themselves to confidentiality or have an appropriate legal obligation of confidentiality (e.g. employees and collaborators of Powersoft);
  • commercial partners of Powersoft in the case of events organized by the Data Controller in which you intend to participate (or have participated);
  • other companies of the Group of which Powersoft is part;
  • public bodies, bodies or authorities to which it is mandatory to communicate your Personal Data for Compliance, Abuse and Fraud purposes, or by orders of the authorities.

5 TRANSFER OF PERSONAL DATA

Your Personal Data may be shared with Recipients who may be located outside the European Economic Area. Powersoft ensures that the processing of your Personal Data by these Recipients is carried out in compliance with the applicable legislation. Indeed, transfers are carried out through appropriate safeguards, such as adequacy decisions, Standard Contractual Clauses approved by the European Commission or others. 6 YOUR RIGHTS

Pursuant to articles 15 et seq. of the Regulation, you have the right to request Powersoft, at any time, access to your Personal Data, rectification or deletion of the same or to object to their processing in the cases provided for by art. 21 of the Regulation, you have the right to request the limitation of processing in the cases provided for by art. 18 of the Regulation, as well as to obtain the data concerning you in a structured, commonly used and machine-readable format, in the cases provided for by art. 20 of the Regulation. We also remind you that you can revoke any consent to the processing of Personal Data that you have provided at any time. You can exercise your rights by writing to the following address: privacy@powersoft.com.

We also remind you that you always have the right to lodge a complaint with the competent Supervisory Authority (Italian Data Protection Authority) if you believe that the processing of your Personal Data carried out by Powersoft is contrary to the regulations in force.

7 CHANGES

This Policy is effective from 15 January 2025. Powersoft reserves the right to modify or simply update its content, in part or completely, also due to changes in the applicable legislation.  We invite you to visit this section regularly to become aware of the most recent and updated version of the Policy in order to be always updated on the data collected and the use that is made of it.
